The 2nd web page of Business Link’s guide says that the “a return to work means the mother has resumed working.” Is this true?

The statement is not supported by reg. 25 of the Additional Paternity Leave Regulations 2010.
In essence, reg. 25 states that the baby’s mother would be treated as returning to work – if the maternity leave period has ended – and she is not being paid SMP (or SMA).

The same page states that "at least two weeks of unexpired statutory maternity leave" is a qualifying criterion for Additional Paternity Leave (APL). This is wrong.
The criterion is related to Additional Paternity PAY (reg. 6(d) of the pay regs) and NOT APL (reg. 4(1)(c) of the leave regs).
